bFocused VA Terms and Conditions

Introduction

These Terms and Conditions govern the provision of virtual services by bFocused VA, a freelance service provider based in Port Augusta, South Australia. Services offered include Business Administration, IT Strategy and Support, and Web Design and Maintenance Services. By engaging with bFocused VA, you agree to these terms.

Services Offered

bFocused VA offers a range of virtual services, including:

  • Business Administration: Tailored administrative support based on your business needs.
  • IT Strategy and Support : IT consultancy, support, and project management services.
  • Web Design and Maintenance: Creation and maintenance of WordPress websites according to your specifications.

Confidentiality & Rights

  • Confidentiality: bFocused VA and associates are obligated to maintain confidentiality regarding all work undertaken and will not utilize it for personal gain or promotion without your written consent. The business affairs of clients will not be disclosed to any third parties without prior written permission from the client.
  • Ownership and Copyright: You retain legal ownership and intellectual copyright of all work executed by bFocused VA or associates. Any images provided by you remain your responsibility regarding obtaining usage rights. Images supplied by bFocused VA or associates are sourced with appropriate permissions.

Turnaround Time

  • Turnaround times for specific tasks will be mutually agreed upon between bFocused VA and you.
  • Delays due to unforeseen circumstances will be promptly communicated.

Payment

  • Payment in Full: You must remit full payment before work commencement. Payment can be made through provided website links on each service page or by requesting an invoice for services.
  • Non-Refundable Payments: Payments are non-refundable, except in cases where agreed services are not delivered.
  • Billing and Payment Schedule:
    • An initial twenty-minute consultation via video conference or telephone is complimentary.
    • Invoices are to be settled within seven (7) days of delivery, unless otherwise agreed.
    • Unpaid bills will incur interest, in accordance with government guidelines.
    • Once an invoice becomes overdue, no further work will be undertaken.

Scope of Work

  • Agreement on Tasks: Initial onboarding meetings will define the tasks to be undertaken. A contract specifying the scope, timeline, and deliverables will be provided for review and signature before work commencement.

Time Limit

  • Usage Period: You must utilize the hours in your package within a specified period from the onboarding meeting. The period is contingent on the chosen package or pre-agreed deadlines. Unused hours within this period will expire and cannot be reclaimed.

Progress Reports

  • Regular Updates: You will receive progress updates via email or brief meetings. Additionally, a report detailing hours used and remaining in the package will be sent at the end of each month or project.

Extra Tasks and Changes

  • Additional Tasks: If extra tasks or changes outside the contract are requested and there is insufficient time in your package, the additional time will be invoiced at the hourly rate. Payment is due within 7 days of receiving the invoice.

Termination of Services

  • Right to Terminate: bFocused VA reserves the right to terminate services in the event of your breach of terms or unforeseen circumstances hindering task completion. Written notification will be provided, and any unused hours in the package will be refunded.

Governing Law

These Terms and Conditions are governed by the laws of South Australia.

Data Protection

In accordance with the Data Protection Act 1998/GDPR, both you and bFocused VA may retain necessary information. Records may be viewed to ensure relevance, accuracy, and currency.

Notice Period

Ideally, termination requires one month’s written notice, but exceptions may be made when this is not possible.

Websites and WordPress

While WordPress and website support is provided, you are responsible for regular backups of your websites unless Website maintenance services are purchased.

Working Hours

Communication outside of the hours of 17:00 Monday to Friday and throughout the weekend will be addressed on the next working day unless otherwise agreed.

Communication

All communication and instructions should be conveyed via email.

Priority for Retained Clients

Retained clients receive priority. Retainer packages, starting from one hour per month, are available at the standard hourly rate.
